Information We Collect
Personally Identifiable Information ("PII")
Company collects information about you through your access to and use of our Websites, including through forms, surveys, quote requests, service inquiries, purchases, and lead generation activities. Any use of our Services is entirely voluntary and you are not required to provide PII unless you choose to use our services. However, you will not be able to access or use our services where PII is required.
PII that may be collected includes your first name, last name, date of birth, email address, telephone number (including mobile), mailing address, home address, zip code, Social Security Number (for tax preparation services only), health information (for insurance quotes and Medicare enrollment), financial information (for credit services, income/expense analysis, tax preparation), payment information (credit card, bank account information), business information (business name, EIN, structure, needs), project details (for design and consulting services), and professional information (license numbers, certifications for agent training services). The specific information collected varies based on which services you inquire about or use.
Protected Health Information ("PHI")
For insurance-related services (including Medicare Advantage, ACA/Marketplace health insurance, life insurance, and ancillary insurance products), we collect Protected Health Information as defined by the Health Insurance Portability and Accountability Act (HIPAA). This may include medical history and current health conditions, prescription medications, healthcare providers and treatment information, height, weight, tobacco use, and other health-related data. PHI is handled in strict accordance with HIPAA regulations. See "HIPAA Compliance" section below for details.
Tax-Related Information
For tax preparation services, we collect information required to prepare federal and state tax returns, including but not limited to Social Security Numbers and dependent information, income documentation (W-2s, 1099s, etc.), expense and deduction information, prior year tax returns, and bank account information for refunds/payments. This information is protected under IRS regulations and our obligations as tax preparers.
Non-Personally Identifiable Information ("NPII")
We also collect certain non-personally identifiable information about you when you visit our Websites. NPII is data used in the aggregate to analyze trends, administer the Websites, track movement, and understand visitor behavior generally. This NPII includes, without limitation, browser type and version, your Internet Protocol ("IP") address, operating system, domain name of your Internet service provider, pages visited, time spent on pages, links clicked, referring website, device type, and screen resolution. We may share NPII with third parties at our discretion.
How We Collect Information
We collect information through direct submission via forms, surveys, quote requests, service applications, and purchase transactions. We also collect information through social media platforms including Facebook, Instagram, LinkedIn, and other platforms where we maintain a presence. Information may be obtained through third-party lead sources such as Help On Demand and FMO/upline warm leads. We collect data through communications including email, SMS/text messaging, phone calls, and video consultations. Our CRM systems, including GoHighLevel and other customer relationship management platforms, collect and store information you provide. We use website technology such as cookies, web beacons, pixel tags, and similar technologies, and we receive information from third-party platforms including payment processors (Stripe), scheduling tools, and email service providers.
How We Use Your Information
We use the information we collect to provide and deliver the services you request, including insurance quotes and enrollment, credit and financial services referrals, tax preparation, business consulting, agent training, and design services. We use your information to process payments and transactions, communicate with you about your services, projects, appointments, and inquiries, send important notifications about your account or services, provide customer support and respond to your questions, and improve our products and services based on your feedback and usage patterns.
We use your information to send marketing communications about products and services that may interest you (with your consent where required), personalize your experience on our Websites, prevent fraud and maintain security, comply with legal obligations and respond to lawful requests, resolve disputes and enforce our agreements, conduct business analytics and research, and share information with service providers who assist us in delivering our services.
Service-Specific Uses
Insurance Services: We use PHI to obtain insurance quotes from carriers, enroll you in insurance plans, assist with claims and customer service issues, and provide ongoing policy management and support.
Credit and Financial Services: We use your financial information to refer you to United Credit Education Services (UCES) and United Wealth Education (UWE) for credit restoration, financial education, and related services. We may also use this information to provide budgeting consultations and setup assistance.
Tax Preparation Services: We use tax-related information to prepare and file your federal and state tax returns, provide tax planning advice, respond to IRS or state tax authority inquiries on your behalf, and maintain required records as mandated by IRS regulations.
Design and Consulting Services: We use project information to deliver branding, web design, and business consulting services, communicate about revisions and approvals, and provide ongoing support during and after project completion.
Agent Training Services: We use professional information to provide appropriate training materials, track your progress through training programs, provide support and coaching, and manage access to training communities and resources.
How We Share Your Information
We share your information with insurance carriers and their authorized representatives when you request insurance quotes or enroll in insurance products. We share information with United Credit Education Services (UCES) and United Wealth Education (UWE) when you request credit, financial, or legal document services through our affiliate relationships. We share information with our Field Marketing Organizations (FMOs) and uplines, including Xell (formerly TrueCoverage), Advocate Health Advisors, Vantage Financial Alliance, and Symmetry Financial Group, for purposes of insurance product delivery, compliance, and commission processing.
We share information with service providers and vendors who perform services on our behalf, including payment processors (Stripe), CRM systems (GoHighLevel), email service providers, scheduling platforms, cloud storage providers, website hosting services, and professional advisors (attorneys, accountants, compliance consultants). We share information with government agencies and regulatory authorities when required by law, including the IRS, state insurance departments, and the Florida Department of Financial Services.
We may share information in connection with business transfers if we are involved in a merger, acquisition, sale of assets, or bankruptcy. In such cases, the acquiring company will assume the rights and obligations regarding your information as described in this Privacy Policy. We may share information with your consent for purposes not described in this Privacy Policy when you provide explicit permission.
We do not sell your personal information to third parties for their marketing purposes.
HIPAA Compliance
Nicolette Management LLC is committed to protecting your Protected Health Information (PHI) in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and related regulations. When we collect PHI for insurance-related services, we implement appropriate administrative, technical, and physical safeguards to protect this information.
PHI is only shared with insurance carriers, their authorized representatives, and our upline agencies (FMOs) for the specific purposes of obtaining quotes, enrolling in coverage, managing policies, and processing commissions. We maintain Business Associate Agreements (BAAs) where required with vendors who may have access to PHI. PHI is stored on HIPAA-compliant systems with encryption and access controls. We train our staff on HIPAA compliance and privacy requirements. PHI is retained in accordance with federal and state record retention requirements and is securely destroyed when no longer needed.
You have the right to access your PHI, request corrections to your PHI, receive an accounting of PHI disclosures, request restrictions on use or disclosure of your PHI, and file a complaint if you believe your privacy rights have been violated. IRS Regulations and Tax Information Security
As a tax preparer with a Preparer Tax Identification Number (PTIN) and Electronic Filing Identification Number (EFIN), Nicolette Management LLC complies with IRS regulations regarding the security and confidentiality of tax return information. We implement IRS Publication 4557 safeguards including physical security of documents and equipment, electronic security measures including encryption and firewalls, administrative safeguards including employee background checks and training, and written information security plans as required by the Gramm-Leach-Bliley Act.
Tax return information is retained for the period required by IRS regulations (minimum 3 years from the due date or filing date, whichever is later) and is securely destroyed after the retention period. We will not disclose your tax return information to third parties without your consent, except as permitted or required by law.
Email and Telemarketing (including SMS/MMS)
By inquiring about, registering for, or utilizing our Services, you expressly acknowledge and agree that Nicolette Management may communicate with you through various means, including but not limited to email, SMS/MMS (text messaging), and telemarketing calls. These communications may include targeted advertising, service updates, promotional offers, appointment reminders, educational content, project updates, tax filing reminders, and marketing related to services or products you may be interested in.
By providing your phone number and/or email address and expressly consenting where applicable, you authorize Nicolette Management to use your personal information, including information reasonably derived from it, to contact you directly or indirectly. Communications may occur via the telephone number you provide, including mobile numbers, regardless of whether your number is listed on any state, federal, or corporate Do-Not-Contact registry or suppression list. Your inquiry and/or registration with our Services constitutes an express request for contact under the Amended Telemarketing Sales Rule, 16 CFR §310 et seq. ("ATSR") and the Telephone Consumer Protection Act (TCPA).
You acknowledge that message and data rates may apply for any SMS/MMS communications depending on your individual mobile carrier and plan. You expressly agree that you are solely responsible for any such charges, that you are at least eighteen (18) years of age, and that you are authorized to use the mobile device and telephone number provided.

Cookies, Web Beacons, Pixel Tags, Log Files and Online Behavioral Technologies
The Websites, Services, and email messages may contain first-party (Company-related) cookies, web beacons, pixel tags, browser analysis tools, and web server logs that enable Company to track your online behavior, collect information regarding your operating system and browser type, record what web page or email you viewed, track the IP address of the device you use to interact with the applicable online service, record when you open or click on a particular online advertisement link or webpage, and additionally for other information gathering purposes such as the language your system uses and the country and time zone of your device.
A cookie is a small file uniquely assigned to you by a webpage server when you visit a webpage or click on a link and can assist in associating your information to a unique profile. Pixel tags and web beacons are tiny graphic images placed on website pages or in emails that allow Company to determine whether you have performed specific actions. When you access these pages or open email messages, the pixel tags and web beacons generate a notice of that action. These tools permit the measurement of responses to communications and improve related promotions.
Log files include IP addresses, browser type, Internet service provider, referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer a website, track user's movement in the aggregate, and gather broad demographic information for aggregate use. As set forth herein, Company collects many different types of information from cookies and other technologies, including, without limitation, what website you were visiting before you came to the Websites, the website you visit after you leave the Websites, and other activities of yours over time and across third-party websites and online services.
Data Security
We implement appropriate technical, administrative, and physical security measures to protect your personal information from unauthorized access, use, disclosure, alteration, and destruction. These measures include secure socket layer (SSL) encryption for data transmission, encrypted storage of sensitive information, firewalls and intrusion detection systems, regular security assessments and updates, access controls and authentication requirements, employee training on data security and privacy, Business Associate Agreements with vendors handling PHI, and compliance with PCI-DSS standards for payment card information.
However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.
Data Retention
We retain your personal information for as long as necessary to provide you with services, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention periods vary by information type and applicable regulations.
Insurance records (including PHI) are retained for a minimum of six (6) years from the date of service or as required by state insurance regulations. Tax preparation records are retained for a minimum of three (3) years from the due date or filing date of the return, whichever is later, or as required by IRS regulations. Financial and payment records are retained for seven (7) years for accounting and tax purposes. Design and consulting project files are retained for three (3) years after project completion. Marketing and communication records are retained until you opt out or request deletion. Account information is retained for the duration of your relationship with us plus seven (7) years thereafter.
When information is no longer needed, it is securely destroyed using methods appropriate to the sensitivity of the information, including shredding of physical documents, secure deletion of electronic files, and destruction of storage media containing sensitive information.
Your Privacy Rights
You have certain rights regarding your personal information. You have the right to access your personal information and request a copy of the data we hold about you. You have the right to correct inaccurate or incomplete personal information. You have the right to request deletion of your personal information, subject to legal retention requirements. You have the right to opt-out of marketing communications via email, SMS, or phone. You have the right to restrict or object to certain processing of your information. You have the right to request portability of your data to another service provider where technically feasible.

Company strives to keep all PII accurate and complete. You are always fully in control of the information that we maintain to service you. You can change your PII at any time and as often as necessary. You can also request that PII be deleted, subject to legal retention requirements.
